Terms of Service

Version 2026-10-10.1 · Effective for agreements made on or after 10 October 2026.

1. Provider and scope

Mindbreakz is operated by Lars Henning Zahl, Schulstraße 28, 68766 Hockenheim, Germany. Contact: info@mindbreakz.com. These terms cover account use, audio uploads, mastering, optional stem separation and the purchased packages. Mandatory consumer rights remain unaffected. Acceptance of this version does not retrospectively change earlier purchases or accrued rights.

2. Service and orders

Mindbreakz processes audio at the user's request. Tracks must not exceed 10 minutes. The selected package, included services, total price, currency, payment interval and any recurring charge are shown before payment. One-time packages and monthly subscriptions are identified separately. Paid entitlements are issued only after confirmed payment. Processing results depend on the source audio; artistic results and suitability for every purpose are not guaranteed. A technical change does not grant permission to distribute, publish or commercially exploit someone else's recording.

3. Your audio and third-party rights

You retain the rights you hold in your audio. Mindbreakz does not acquire ownership, publishing shares or royalty interests. Upload and processing are permitted only when you have the necessary rights, permissions or an applicable legal authorization. This includes rights in the recording, composition, lyrics, performances, samples and other third-party material. A streaming subscription or possession of a file does not by itself establish those rights.

You must not upload or process material in violation of third-party rights, circumvent access controls, or use the service for unlawful purposes. Before uploading, you must actively confirm your authorization. You remain responsible for checking the rights needed for your subsequent use of the results. Lawful uses and statutory exceptions remain unaffected.

4. Limited processing permission and providers

To the extent you are entitled to do so, you authorize Mindbreakz to store, technically copy, analyse, transform and deliver the submitted audio solely to provide the services you request, including necessary processing by the disclosed providers. This permission is limited to that purpose and the applicable retention period; it does not authorize public distribution, advertising with your audio or training models on it.

Mastering is hosted on IONOS infrastructure in Germany. If you select Fadr separation, the source mix is sent to Fadr and the resulting stems are returned to Mindbreakz. Provider-side deletion has not been confirmed. Deleting a Mindbreakz project must not be assumed to remove copies held by Fadr. See the Privacy Policy. Your acknowledgement does not waive data protection rights or replace the provider's or Mindbreakz's legal obligations.

5. Rights reports and proportionate measures

Use Report a rights violation to identify disputed material and explain the legal grounds. Include sufficient information to locate the specific content and a contact address. We acknowledge reports, assess them without assuming that every report is correct, and take appropriate measures where justified. These may include stopping processing, restricting access or removing unlawful material. Repeated or serious violations can lead to proportionate account restrictions or termination. Where required, affected users receive reasons and information about available redress. You can contest a decision at info@mindbreakz.com, quoting its reference. These terms do not limit rights holders' statutory claims or lawful authority orders.

6. Consumer right of withdrawal

If you are a consumer, you generally have the right to withdraw from a distance contract within 14 days without giving a reason. For the services and non-physical digital content offered here, the period generally runs from contract conclusion, subject to receipt of the legally required information. To exercise this right, inform Lars Henning Zahl, Schulstraße 28, 68766 Hockenheim, Germany, email info@mindbreakz.com, by a clear statement. You may use the Withdraw from a contract function or the model form below, but use of a particular form is not mandatory. Sending your statement before expiry of the period is sufficient.

If you withdraw, payments covered by the withdrawal are reimbursed without undue delay and no later than 14 days after receipt, using the original payment method unless expressly agreed otherwise, without reimbursement fees. Any lawful payment for services already supplied requires the applicable statutory conditions. Early expiry differs for services and digital content (§ 356(5) and (6) BGB) and requires the relevant explicit declarations and, where applicable, contract confirmation. Payment, upload, a checkbox accepting these terms, or the start of processing alone does not waive your statutory withdrawal right. We do not treat acceptance of these terms as an early-expiry declaration.

7. Subscription cancellation

Monthly subscriptions renew for another monthly period unless cancelled. You may give ordinary cancellation notice for the end of the current paid period; the right to extraordinary termination for good cause remains unaffected. Use Cancel a subscription without signing in, or send a clear statement to info@mindbreakz.com. State the contract and your requested end date; if no date is specified, the earliest legally possible date applies. We acknowledge receipt and confirm the applicable end date after identifying the contract. You do not need to confirm a second email to submit your declaration. Statutory cancellation rights, including consequences of a defective cancellation facility, remain unaffected.

8. Retention, account deletion and records

Master availability follows the selected tier: free masters for 24 hours, paid single masters for 14 days, and Pro Studio storage during the active subscription. Keep your own copies. Source uploads have a separate lifecycle. Account deletion removes account-linked audio from Mindbreakz, subject to lawful restrictions and technical completion; it does not automatically cancel a Stripe subscription or remove Fadr-held copies. Cancel any subscription as well. Financial records and records needed for legal obligations or claims may be retained as required. Consent and declaration records document the applicable text, version and time; legal requests and correspondence are restricted to handling the request and related legal obligations or claims. 9. Liability and applicable law

Statutory liability and warranty rights apply. No provision excludes liability that cannot lawfully be excluded or makes customers responsible for Mindbreakz's own violations. German law applies, without depriving consumers of mandatory protections of the law that would otherwise apply to them. Statutory jurisdiction rules apply.
